Do you think this is uncanny, or aimed at Deadheads- or just avoiding copyright issues?

I mean I gotta think the artist is aware that its Grateful Dead iconography. How would this be avoiding copyright issues? The original skull and roses isnt even owned by the Grateful Dead:
