While we're crushing windpipes, poppin' a couple in the nether regions and dismembering penises (albeit only pychologically, nice one bobby!), I got to wonder about all the aggression pumped up for a high school kids problem. Are we maybe living vicariously through this kid?
Don't go over to the guy's house. And though not throwing the first punch speaks to cupability, you can't count on beating an assault rap on that evidence. I have an assault and battery on my record, and for years I convinced myself that I was wrongfully to blame because the other guy threw the first punch. But he aggravated me and I went over to his house and all the way I was thinking "OK this is it, throw down time." Also being at his house allowed for his people to back him with the law. It's been a long time and still I have to put on a very convincing story during job interviews. I've been lucky so far but the way the society is going in the war on terror I worry about that mark on my record for a violent crime, even the misdemeanor that it was.

Technically, yes, if it was discovered, which although possible, isn't likely. I think the premise for the law to go searching through computers would start if someone commited a serious crime (rape, murder, arson, rape....), not just for knocking some kid in the grill.

dude dont hit the boy. I have never been in a fight and would truthfully be sacred to death if I were in one. This reminds me of a situation that just happened the other day.......It all started when I this gangsta kid hooked me up with the schmyest bowl ever, it was almost an insult. After I confront him about it he gets all in my face and makes a big scene out of it, "do something about it you fuckin' pussy" is what he yelled. I just said no because it was only a bowl and its only herb. This kid laughs at me everytime I see him and he acts all cocky about it, and so what? he's just a jackass, much like this kid in your class. My 2 cents says not to do anything and just ignore him. Plus, your a hippy and hippys cant go round' throwin punches.

This might be something I need to just get over and most of the time I just bite my tounge. But I hate it when someone calls me a "hippie". Even if it comes from another "hippie". I don't know why it bugs me, it just does. I think I stopped wearing tie dies out in public just so I didn't have to hear the word as much.

But yeah I recommend you don't throw down if you can help it. Personally I don't think this a reason to want to fight. Call him out verbally like I said and defend yourself that way but no need in punches. It really can be a big trouble, with criminal record and kids today not being able to take defeat and actually coming back at you with a weapon. I can't say I regret every fight I've been in, but afterwords I know there was probably a better way to deal with it. I haven't really gotten in a fight in a very long time but I will admit there are still some things in my book worth fighting over. I'm a peaceful man, but if you threaten me or wife or dogs I will fight with every once of me.

My advice, go see a counselor and asked to be transfered to another class. Also state that this guy is affecting your your ability to focus on school and its affecting your grades. Take your buddy with you
If the counselor doesnt transfer you they become liable for anything that happens and you have a good chance at not getting suspended

LOL! I like this advice. I say that assuming the other dude has physically threatened you. IMO walking away, other cheek, transferring classes, etc just sets the foundation to be a life-long punching bag for somebody.

Jesus, what a lot of different and interesting advice! I appreciate it very much. Turns out my mom decided to tell my dad about it and my dad, in all his wisdom, e-mailed my teacher. The teacher talked to me and the kid, (separately, of course), and he hasn't said anything to me since. This was on Wednesday. Everything is cool for now. I don't know if he'll start again but I'm hoping he doesn't. Although I'm not the kind of kid to start fights, I was basically wondering what you guys had to say about the situation. Some I agreed with, some i laughed at, and some I completely disagreed with. Btw, the only reason I wasn't gonna throw the first punch is because if I did that, I'd get in the most amount of trouble. No matter how much he instigated me. Anyhoo, thanks a bunch for the words of wisdom.

I am not advocating violence, but I think there is a time and a place for retaliation of the physical kind. Hard to imagine a prosecutor going after a teenager for a fight at school, but you never know. Just make sure you never carry a weapon. Even in college I got away with the fights I was in as far as local law enforcement is concerned. When you are out of college, then it is very important not to get into fights because assault charges are not pretty.

If the situation does arise, and you get into a fight in public here is a wise tip a lawyer friend of mine mentioned to me. If fists are about to be thrown, announce out loud "I want nothing to do with this person, I want nothing to do with this person."

Often, this will clear you of the assault as there are witnesses who can attest to the fact that you tried to prevent the fight.

If it does get physical, my personal advice is to head butt him on the bridge of his nose. If you connect, his nose will break, his eyes will water, and he will never see it coming. No one expects the head butt. Plus, you are a guitar player, I can tell you from experience, your hands will not be fit for guitar for a few days or longer if you do connect some blows to his face. You can easily break a wrist. So guitar players should think head butt first, punches last.

A front kick to his knee will also make him think twice about ever messing with you again.

I wish you all the best in this situation and hopefully it can be resolved non violently. But some situations call for a firm and physical hand just because some people are real douchebags and deserved to have their asses kicked once in a while.

Most of the ideas presented here have some fatal flaws:

1. By going to someones house, you now become the aggresor in the eyes of the law
2. Anything pertaining to drugs will definately get you jailed.
3. If in fact you beat the tar out of this kid, you could find yourself suspended, jailed or both.(with no guarantee he wont come after you again.
4. If he beats the tar out of you, you will forever be fearful he will do again, which he will.
5. If you severally beat this kid you could do permanent damage or death.

You only need to checkout last weeks headlines to see what kind of trouble you can get into.

Gotta disagree. I teach my students that there is only one acceptable reason to hit someone: You're too stupid to do what's right. I am not a pacifist, but violence begets more violence and only teaches that it is a proper solution to a problem, which I have NEVER EVER seen, nor will I ever.
