While looking for Russian Lullaby, I noticed that it along with some others are no longer available. What's the reason for this??

I noticed too. Lots of them are missing. Seems mostly Garcia band and Grisman lyrics and chords. I hope to god this isn't more jackbooted thuggery from gdp or any other authority to which I have given thousands and thousands of dollars to in my 20 years as a deadhead.

yes, it is only the songs written by members of the dead and traditional tunes that are availiable. Im not sure why, some legal thing.

Since they've been down, I've been cataloging who exactly owns each song, seaching ASCAP and BMI and the MPA to see exactly what the deal is. With the Grateful Dead, this is extremely easy, and contacting requires one phone call: Ice Nine Publishing. I think it is amazing that Robert Hunter has been able to retain the rights to his music, considering that just about everyone else has not been able to.

Let's take "Russian Lullaby" by Irving Berlin. Who do you ask to get permission to use his work, or do you have to?

First, you need to look at one of these two sites:

or

BMI Music Search

A single artist may belong to one or both of these organizations. Also, a single artist may have multiple publishers, all of whom may belong to one or both of these organizations.

To make it quick, Russian Lullaby is under ASCAP, Title Code: 480062439.

There you will find information regarding people who have performed the song, and also who owns the publishing rights.

Now lets look at lyrics, when I go to his site

So, I ask: Why, if the publishers who own the rights to this song don't put up the lyrics, why should anyone else without their permission? Without even asking, I have a good feeling about their policy of having lyrics or music on the internet.

Does the posting above by mike0987654 or strumminsix infringe upon Irving Berlin's music? I think the actual chord progression does not. In terms of lyrics, the first verse also looks to be a parody of the original. However, the second verse is pretty much exact. Also, is the work close enough to the original that people would use it instead of one the author published? The artist has the right to pursue all avenues of making money, even if they don't have to capabilities to do it. For instance, a painter sued a sculptor for copyright infringement because the sculptor make a sculpture of the painting. The sculptor said it is a parody, but the judge ruled that it infringed on the owners ability to make money selling sculptures of their paintings. There is a common misconception that "Free" is "Fair Use". That is not true. It also doesn't limit how an artist sees you infringing on their work.

Copyright law allows to comment and critique on Russian Lullaby. Without it, there'd be no criticism or Saturday Night Live. These forums are meant to do exactly that. Add to the work. I think that explaining how Jerry played this song is totally acceptable. Tabbing his riffs is free game. Tabbing his chord progressions are free game. Using his unique parody on the lyrics is free game.

So, based on ed's tab, I think that Russian Lullaby on this site should look like this:

I'd rather have the lyrics too, but my new found belief is that permission is the best policy. And that is what I am working on.

What Gregg is saying is that posting the tabs for songs that have been taken off the site here in the forums is essentially no different than having them posted on the site; for all the same reasons that they were removed from the site.

Reason: These forums are public access, same as the web-site. No special fee is collected, and thus no royalty paid to the publisher of concern.

It's a drag to get involved with all this legal stuff, but you have to ask yourself......what if YOU were the author? Maybe you'd be ok giving it away, maybe not. But without getting your permission, you probably would not be happy about someone else making that decision for you without consulting you.
