The flatted 7th works and it becomes a lydian dominant 7th (e7#11) chord. The lead played over that chord uses the 4th mode of B melodic minor.
It sounds much worse than it is. The melodic minor scale is the same as a major scale except that it has a minor third rather than a major third. The melodic minor modes are quite interesting.
